Terms of Service (ToS)

§ 1 Service Provider & Scope

These Terms of Service govern the use of the file hosting infrastructure "Pneumatic" provided by Pneumatic Media UG (haftungsbeschränkt) (hereinafter "Provider" or "We").

We act exclusively as a neutral technical intermediary (Host-Provider) providing storage and bandwidth. We do not aggregate, index, promote, curate, or publish user-uploaded files.

§ 2 Absolute Liability Exclusion (Safe Harbor)

Pursuant to the European Digital Services Act (DSA) and equivalent international Safe Harbor frameworks, the Provider is completely exempted from liability for the information stored at the request of a recipient of the service.

• No General Monitoring: We have no general legal obligation to monitor the information transmitted or stored, nor to actively seek facts indicating illegal activity (Art. 8 DSA).
• Exclusive Uploader Liability: The user uploading the file ("Uploader") bears 100% of the civil and criminal liability for the file's nature, copyright status, and distribution.
• No Assumption of Content: We explicitly disassociate ourselves from all user-uploaded content. The presence of a file on our servers does not imply endorsement or knowledge of its content.

§ 3 Zero-Knowledge Architecture

The platform employs client-side and server-side encryption routing.

Technical Limitation: The Provider is architecturally incapable of decrypting, previewing, or semantically analyzing the raw bytes of user files in plain text.

Consequently, the Provider cannot verify the legality of a file proactively. Any claims of copyright infringement or illegality must be directed through our reactive Notice and Takedown procedure.

§ 4 Notice and Takedown Enforcement

Upon receiving a highly specific, legally valid, and actionable abuse report (DMCA / DSA Notice) containing exact URLs, the Provider acts expeditiously to remove or disable access to the infringing material ("Shadow-Block").

Users who repeatedly infringe copyrights or upload prohibited materials (e.g., CSAM, terrorism, malware) will face immediate, permanent account termination without refunds.

§ 5 Absolute Indemnification

The Uploader agrees to fully indemnify, defend, and hold harmless Pneumatic Media UG (haftungsbeschränkt), its directors, employees, and affiliates from ANY and ALL claims, demands, damages, liabilities, and legal fees (including attorney's fees) arriving from the Uploader's violation of law or third-party rights.
